Terms of Service

Short version: 617 Nation is a fan community. Be respectful, post stuff you have the right to share, don't break the law, and we'll show you Red Sox content. We can remove content or accounts that don't follow these rules.

1. Acceptance of these terms

By creating an account or using the 617 Nation app or website (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree to these Terms, don't use the Service.

617 Nation is operated by EBJ Ventures ("we," "us"). You can reach us at hi@617nation.com.

2. Who can use the Service

You must be at least 13 years old to use 617 Nation. If you're between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You're responsible for the security of your account. Don't share your sign-in credentials.

3. Your content

"Your Content" means anything you post to the Service: clips, comments, chat messages, profile information, and avatars.

You own Your Content. Posting to 617 Nation doesn't transfer ownership. However, by posting, you grant us a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, and distribute Your Content as part of operating the Service — for example, showing your clip in another user's feed.

You're responsible for Your Content. When you post a clip you represent that:

You own it or have permission from the rights-holder to share it.
It doesn't violate any third party's privacy, publicity, or intellectual property rights.
It doesn't violate the rules below.

4. Community rules

You may not post Content that:

Harasses, threatens, or impersonates another person.
Contains hate speech, slurs, or targeted attacks based on race, ethnicity, religion, gender, sexual orientation, disability, or similar protected characteristics.
Is sexually explicit or sexually suggestive.
Depicts graphic violence, self-harm, or abuse.
Promotes illegal activity.
Contains spam, scams, or off-topic promotional content.
Infringes someone else's copyright, trademark, or other intellectual property.
Contains malware, phishing links, or other security threats.

You may also not:

Use the Service to harass, dox, or stalk anyone.
Attempt to bypass our moderation or rate limits.
Scrape, mirror, or republish content from the Service without permission.
Reverse engineer, decompile, or modify the App except as permitted by law.
Create accounts to evade enforcement actions.

5. Moderation and enforcement

We can remove Content, suspend accounts, or terminate accounts that violate these Terms, at our discretion and without prior notice. For serious or repeated violations termination may be permanent. We may also report illegal activity to law enforcement.

If your Content is removed, you can email us at hi@617nation.com to appeal.

6. Third-party content (X / Twitter)

The Service displays some content sourced from public posts on X (formerly Twitter), with attribution and links back to the original posts. We don't claim ownership of this content; it remains the property of the original authors. If you're a creator whose X content appears in 617 Nation and you'd like it removed, email us at hi@617nation.com with the URL and we'll remove it within 48 hours.

7. DMCA / copyright

If you believe content on 617 Nation infringes your copyright, send a notice to hi@617nation.com including:

A description of the copyrighted work you claim is infringed.
The URL of the infringing content on 617 Nation.
Your contact information.
A statement, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf, and that you have a good-faith belief that the use is not authorized.
Your physical or electronic signature.

We process valid DMCA notices in accordance with the Digital Millennium Copyright Act and will terminate accounts of repeat infringers.

8. MLB and Boston Red Sox trademarks

617 Nation is an unofficial fan app. We are not affiliated with, endorsed by, or sponsored by Major League Baseball, the Boston Red Sox, or any of their affiliates. All MLB and Red Sox names, logos, and trademarks are the property of their respective owners.

9. Live game data

Live game scores, plays, and statistics are sourced from publicly available APIs. We make no warranty as to accuracy or timeliness — there may be a delay or occasional error. Don't rely on 617 Nation data for any purpose where accuracy is critical (including betting).

10. Service availability

We work to keep the Service running but don't guarantee uninterrupted availability. We may modify, suspend, or discontinue the Service (or any feature) at any time. We're not liable for any inconvenience caused by downtime or changes.

11. Termination

You can stop using the Service at any time. You can delete your account by emailing us at hi@617nation.com. We can terminate your account if you violate these Terms.

On termination, your right to use the Service ends. The license you granted us to display Your Content ends as well, except that we may retain copies for legal, backup, or moderation-record purposes for a reasonable period.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EBJ VENTURES AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED $100 USD.

14. Indemnification

You agree to indemnify and hold harmless EBJ Ventures, its officers, and its employees from any claim, loss, or liability arising from Your Content, your use of the Service, or your violation of these Terms.

15. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Suffolk County, Massachusetts, and you consent to the jurisdiction of those courts.

16. Changes to these terms

We may update these Terms from time to time. If we make material changes we'll update the "Last updated" date at the top and, for significant changes, notify you in the App. Continued use of the Service after a change constitutes acceptance of the new Terms.
